Key UAE Employment Rights

Under Federal Decree-Law No. 33 of 2021 (effective February 2022).

Gratuity (Article 51)

21 days/year for first 5 years, 30 days/year after. Resignation no longer reduces gratuity. Must be paid within 14 days.

Notice Period (Article 42-43)

30-90 days as agreed in contract. Must be in writing. Employer can pay salary in lieu of notice period.

Non-Compete (Article 10)

Maximum 2 years. Must be limited in scope, geography, and nature of work. Not enforceable in all situations.

Arbitrary Dismissal (Article 47)

If fired for non-work reasons, claim up to 3 months' gross salary compensation.

Leave Entitlements

30 days annual leave, 90 days sick leave, 60 days maternity, 5 days paternity. All per UAE federal law.

MOHRE Disputes

File complaints via MOHRE. Resolution within 14 days. Claims under AED 50,000: MOHRE issues binding decision.
