10 Red Flags in Your UAE Tenancy Contract

Not all tenancy contracts are created equal. Some contain clauses that are unfair, unenforceable, or even illegal. Here are 10 red flags to watch for before you sign.

Red Flag 1: No Early Termination Clause

Without an early termination clause, you are locked in for the full contract period. If you need to leave early, you will be at the landlord's mercy for negotiation. Always ensure there is a clear exit mechanism.

Red Flag 2: Unlimited Rent Increase at Renewal

Some contracts state the landlord can increase rent "as they see fit" at renewal. This contradicts Decree 43/2013 in Dubai and is unenforceable — but it signals a landlord who may be difficult.

Red Flag 3: Tenant Responsible for All Maintenance

Clauses making tenants responsible for structural repairs contradict Article 16 of Law 26/2007. Landlords must handle structural maintenance — any clause saying otherwise is legally void.

Red Flag 4: Non-Refundable Security Deposit

If the contract states your security deposit is non-refundable, this is a major red flag. Deposits must be returned minus legitimate deductions for damage beyond normal wear and tear.

Red Flag 5: No Mention of Ejari/Tawtheeq Registration

If the contract does not address registration, the landlord may intend to avoid it. Insist on adding a clause requiring timely registration.

Red Flag 6: Excessive Penalties for Late Payment

Some contracts impose heavy penalties for late rent payment (e.g., AED 500/day). While late fees are common, excessive penalties may be unenforceable.

Red Flag 7: Landlord Can Enter Without Notice

Your privacy is protected by law. The landlord should only enter with reasonable notice (typically 24 hours) and for legitimate reasons (maintenance, inspection).

Red Flag 8: Automatic Rent Increase at Renewal

Some contracts include pre-set increases (e.g., "rent increases 10% annually"). In Dubai, this is only valid if it falls within the RERA brackets. In Sharjah, any increase during the 3-year freeze is void.

Red Flag 9: Waiver of Right to File Disputes

Any clause requiring you to waive your right to file at the RDC or dispute authority is unenforceable. You always have the right to access the legal dispute process.

Red Flag 10: Vague Property Description

The contract should clearly describe the property — unit number, size, parking, included furnishings. Vague descriptions lead to disputes later.
