Landlord Won't Return My Cheques After Ejari Cancellation: Recovery Playbook

Why This Matters More Than You Think
A cheque in Dubai is a legally binding instrument. If presented, it goes through the bank automatically. A bounced cheque can lead to civil and (depending on circumstances) criminal exposure. Even a "stale" cheque a year old is presentable. Letting the landlord keep them is taking on real risk you have no obligation to bear.
Step 1 — Document the Move-Out (Same Day)
- Photos of every room, taken with timestamps
- Signed handover document from the landlord or agent
- Ejari cancellation receipt
- DEWA final clearance

Step 2 — Formal Written Demand (Day 1)
Send an email and a printed letter. Include:
- Reference to the lease end date and Ejari cancellation
- A list of the cheque numbers and amounts you handed over
- A 7-day deadline to return the cheques
- A clear statement that any cheque presented after lease end will be reported as fraudulent

Step 3 — Notify Your Bank (Day 1–3)
Call your bank and explain: a previous landlord is holding cheques against a closed tenancy. Ask whether you can place a stop payment on those specific cheques. Banks generally accommodate this when there is no underlying obligation. Get written confirmation if you can.
Step 4 — File at the RDC (Day 7+)
If the deadline passes with no return, file an RDC complaint. The filing fee is the same 3.5% of annual rent formula. The petition asks for:
- Order to return all unencashed cheques
- Damages if any have been banked
- Order against future presentation

Step 5 — If a Cheque Is Banked Anyway
- Within 24 hours: report to your bank and request a recall/return.
