Is This Eviction Notice Actually Valid? 7-Point Dubai Checklist

Your landlord just sent you what looks like a 12-month eviction notice. Email? WhatsApp? A printed letter? Before you start packing or panicking, run it through this checklist. A large fraction of "eviction notices" Dubai tenants receive are not legally valid — and an invalid notice has no legal force.

The 7-Point Checklist

3States one of the four legal grounds (personal use, sale, major renovation, demolition)?Not valid. Any other reason is not enforceable.
4If "personal use" — names the specific occupier (landlord, parent, child, spouse)?Probably not valid. RDC requires identification of the personal-use occupier.
5If "sale" — supported by actual evidence of sale process (DLD transfer filed, broker contract, etc.)?Weak case. RDC frequently rules against landlords who cannot show actual sale activity.
6Issued in the landlord\'s own name (not a real estate agent, not the building manager)?Not valid without a notarised power of attorney from the landlord.
7Signed and dated by the landlord or notary?Defective. RDC will reject.

The Most Common Tactics — All Invalid

  • "12-month notice" via email or PDF attachment. Not delivered through a notary or registered mail. Invalid.
  • WhatsApp message stating "we won\'t renew". Invalid.
  • Eviction notice from an estate agent, not the landlord. Invalid without a notarised power of attorney.
  • Vague "personal use" without naming the occupier. RDC will scrutinise; often invalid.
  • Notice served 6 months before expiry. Late. You can keep renewing.

If Your Notice Fails the Checklist

  1. Do not vacate. Continue paying rent on the existing terms.
  2. Respond in writing citing the specific defect. Use our Eviction Response Notice generator (AED 99) — it cites the right laws (Law 26/2007, Law 33/2008, Decree 26/2013).
  3. If the landlord files at RDC, present your response and the defect. RDC routinely rules in favour of tenants when the notice is procedurally defective.
  4. If the landlord changes locks, cuts utilities, or harasses, file an emergency complaint at RDC — these are separate offences.

If the Landlord Did Get It Right

If all 7 boxes are ticked and the ground is legitimate, you have 12 months to plan your exit. Use the time to find a comparable replacement at the current Smart Rental Index. Note: if the landlord evicts for personal use but rents to someone else within 2 years, you can claim compensation up to 2 years of rent.
