Can I Leave the UAE With an Open MOHRE Case?

May 20, 2026 · 5 min read

You filed your MOHRE complaint. Now your visit visa is expiring, or your family needs you home, or your nerves are shot. Can you actually leave?

The Short Answer

Yes, unless a travel ban has been issued against you. A MOHRE complaint on its own does not create a travel ban. Travel bans are separate legal instruments, typically issued by a court in financial or criminal cases.

Check for a Travel Ban Before You Book

  • Dubai: Dubai Police app or call 901.
  • Abu Dhabi: Abu Dhabi Police app.
  • Federal-wide: Ministry of Interior / Smart Services portal.

The check is free and instant. Do it before paying for a flight.

What Actually Continues After You Leave

  • MOHRE settlement attempts proceed remotely. The labour officer calls you on the number you provided.
  • Labour court hearings can proceed in your absence if you appoint a lawyer via power of attorney.
  • Enforcement against the employer (asset seizure, account freeze) is jurisdictional — it operates inside the UAE regardless of where you are.

What to Do Before You Leave

  1. Update MOHRE with your overseas number and email. Through the app or 80060.
  2. Appoint a lawyer if the case is heading to court. A simple notarised power of attorney is enough.
  3. Take physical copies of all evidence with you. Bank statements, contract, payslips, the formal complaint letter — keep a sealed offline copy.
  4. Verify your visa status. If your employer has cancelled your visa unilaterally, ensure you have a valid exit pass.
  5. Keep your UAE bank account open if possible — easier to receive settlement payment.

Special Cases Where You Should Wait

  • Cheque-related case — if the employer filed a criminal case over a cheque, leaving while the case is active can be considered absconding.
  • Absconding case filed against you — leave first only after the case is resolved or you have legal representation in place.
  • Active immigration ban — your case may still proceed but re-entry is barred until cleared.
