UAE Probation Period Rules: What Employees Need to Know
Starting a new job in the UAE? The probation period is a critical time for both you and your employer. Here's what the law says about your rights and obligations.
Maximum Probation Duration
Under Federal Decree-Law No. 33 of 2021, the probation period in the UAE:
- Cannot exceed 6 months
- Cannot be extended or renewed
- Must be clearly stated in the employment contract
- Starts from your first day of work
Termination During Probation
If Your Employer Wants to Terminate You
- Must give 14 calendar days written notice
- Must pay you for the notice period (even if they don't want you to work it)
- No need to provide a specific reason
If You Want to Resign
- To join another UAE employer: 1 month written notice + reimbursement of recruitment costs to current employer (if they paid for your visa/recruitment)
- To leave the UAE: 14 calendar days written notice
- New employer responsibility: If you're joining another UAE company, the new employer must compensate the original employer for recruitment costs
What You're Still Entitled To During Probation
- Full salary as agreed in your contract
- Overtime pay for hours beyond 8 per day
- Weekly rest day (usually Friday)
- Workplace safety protections
- Protection from discrimination and harassment
- Reduced hours during Ramadan
What You're NOT Entitled To During Probation
- Annual leave: Accrues but typically cannot be taken during probation
- Sick leave: Paid sick leave starts after probation (3 months service minimum)
- Gratuity: Requires 1 year of service
- Return ticket: Only applicable after probation if specified in contract
After Probation
If you continue working past the probation end date without any notice from your employer, you're automatically confirmed as a permanent employee. Your probation period counts toward your total service for leave and gratuity calculations.
Red Flags to Watch For
- Employer extending probation beyond 6 months (illegal)
- Contract stating no notice period during probation (illegal — 14 days is mandatory)
- Employer withholding salary during probation
- Being asked to sign an undated resignation letter
