My Manager Won't Accept My Resignation in UAE — What Now?

May 20, 2026 · 5 min read

"I am not accepting your resignation." A surprising number of UAE managers still say this. Spoiler: they cannot. A resignation in the UAE is a notification, not a request — once delivered, the clock starts whether your manager likes it or not.

The Law

Under Federal Decree-Law 33/2021 Article 42, resignation is effective on delivery to the employer. There is no requirement of acceptance. Your notice period — typically 30, 60, or 90 days as set in your contract — runs from the day after delivery.

How to Deliver a Resignation That Cannot Be Disputed

  1. Put it in writing. Email is fine. Letter is better. Both is best.
  2. State the last working day clearly. "My last working day will be [date], based on a [X]-day notice period under Article 42."
  3. Send to HR and your direct manager. Reduces the "I never got it" risk.
  4. Request a written acknowledgement of receipt. Even a "thanks, received" reply works.
  5. If they refuse to acknowledge, send via the company\'s official email plus registered post / courier with delivery confirmation.

Common Manipulation Tactics — and the Counter

TacticWhat it actually meansWhat to do
"I am not accepting your resignation."No legal effect — your notice has started.Reply in writing confirming the notice period continues.
"You can\'t leave until you find a replacement."No legal basis.Politely note that hiring is not within your remit.
"We will mark you absconding."Empty threat — you are working your notice.Save the message. See our absconding guide.
"We won\'t cancel your visa."Visa cancellation is a labour-law obligation. If they refuse after final working day, see our visa-hostage guide.

If They Get Aggressive During the Notice Period

  • Document everything. Screenshots, emails, voice notes if legal in your case.
  • Continue performing your role professionally — do not give them cause for an "absence" or "misconduct" claim.
  • If wages, benefits, or your final settlement are threatened, file with MOHRE before your last day.
